Looking ahead Inc., hereinafter known as; “Looking ahead”, “LA”, “We”, “Us”, “The Website”, “The Mobile Website”, “The Mobile App”, “Our Solution”.
1) Do we collect your information and why?
The Looking Ahead services collect information from users in order to; perform any user-generated request, identify possible future enhancements, help with diagnostics and efficiencies, facilitate any services with any third party partners, and any other reason Looking Ahead may feel is necessary and warranted to contribute or to help execute its services to end users. Information collected from end users may have its origins from either the; Website, Mobile Website, Mobile App, and any other direct form of correspondence you may have with us. You understand that you are freely providing this information to us in order to have access to our systems and to execute any of our services. Information collected from end users may include (but not limited to); your personal information, your browser and/or mobile device information, diagnostic information, financial information, GPS and other location based information as well as any other information you may enter while using the Looking Ahead services. Looking Ahead will not share any of your personal information with any non-approved third party. Any information that we do share is information that we feel is critical in the delivery of our services to you.
2) Who do we share your information with and why?
Other Individuals or entities who may have limited or full access to your account may include the following:
1. Our own employees or approved individuals or companies or sub-contractors we retain to perform services for us. All of our employees and any approved third party partners are bound by strict and enforceable confidential agreements.
2. Any governmental agency or law enforcement agency that requests from us and produces an access order to us that is native to the jurisdiction of Ontario or Canada. Looking Ahead will comply with any order that we are legally required to do so, for reasons of (but not limited to) crime prevention, law enforcement investigation, bankruptcy or insolvency, family matters disputes, estate affairs, or for personal or public safety. When we receive a request for access to your account, Looking Ahead will take reasonable steps to ensure the enforceability and validity of such an order before any information is released. Depending on the nature and contents of any order, Looking Ahead may or may not notify you of any execution of an order.
3. Looking Ahead will disclose your account information to any party who acquires all or parts of Looking Ahead’s business through purchase of our assets, merger/acquisition or consolidation. Looking Ahead will provide end users with sixty (60) days’ notice should the ownership structure materially change. The choice to continue or cease services beyond any ownership change will be at the users sole discretion.
4. Looking Ahead will disclose all of your personal account information to any legal representative representing Looking Ahead for any purpose at Looking Ahead’s sole discretion.
5. Looking Ahead reserves the future sole right to disclose any account information we feel is reasonable to any third party whom we feel serves our interests.
3) Your Username/Password, and any data you enter into your Looking Ahead account.
You acknowledge and agree that it is your sole responsibility for protecting your personal privacy and account information when accessing our services through any access point that you choose to access from. You are solely responsible for maintaining the confidentiality of your username and password. You agree that Looking Ahead bears no responsibility or liability for any; lost/stolen account information, any consequential damages, general harm to you, damages (financial or otherwise) or other injury or damages which may result from user usage or from any unauthorized usage of your account. Your data that you enter into your account is encrypted while “in transit” to us (from your screen to our servers) and while at “rest” (stored within our servers and infrastructure). Looking Ahead uses industry standard encryption methods to store and to ensure that your data is protected. 4) Your Payment Information
Any payments made to Looking Ahead by a credit card are processed through our third party merchant services partner. Your credit card information is encryption protected “end to end” from your screen through to our merchant services provider. You payment information will not be shared with any other third party. Our internal systems are designed that only a handful of our employees have access to your payment information.
5) Notifications from Looking Ahead
You, hereinafter known as; “you” and “the end user”
Looking Ahead Inc., hereinafter known as; “Looking Ahead”, “LA”, “We”, “Us”, “The Website”, “The Mobile Website”, “The Mobile App”, “Our Solution”.
We are excited that you have decided to use Looking Ahead! We offer a great service that can be useful and enjoyable. We have prepared the below document so that you understand the uses and limitations of our services (the “Services”).
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS (THE OR THESE “TERMS”) CAREFULLY IN THIS DOCUMENT. By clicking your agreement to these Terms, which is a pre-condition of your subscription for the Services you, on behalf of yourself and your heirs and successors, are confirming your acceptance of these Terms as a whole, on your own behalf and on behalf of any entity for whom you are acting on behalf of. If you do not agree to these Terms you will not be able to subscribe to our Services. If you do not abide by these Terms, you should cease using the Services immediately.
In addition to all other terms in this document, the following special terms are applicable:
a) We offer two different kinds of subscriptions; a yearly subscription (“Yearly Subscription”) and a “Lifetime” subscription (“Lifetime Subscription”). The yearly subscription requires payment on a yearly basis for you to use the Services. The “Lifetime” requires a one-time payment and no yearly fee to use the Services. A “Lifetime Subscription” does not necessarily entitle you to use the Services for your lifetime; rather it entitles you to use the Services without further subscription fees for as long as We continue providing the Services. We intend to offer the Services indefinitely, but if for some reason we are not able or willing to continue to offer the Services, Lifetime Subscription customers will not receive any refund provided that they have received at least twelve (12) months of Services.
b) We may terminate your use of the Services upon 30 days’ notice for any reason, and We may terminate Your use of the Services without any notice if the termination is as a result of your misuse of the Services in our sole unfettered discretion (collectively referred to herein as, “Early Termination”).
c) No refunds are payable for either Yearly Subscription of Lifetime Subscription customers for Early Termination if the termination as the result of Your misuse of the Services. Lifetime Subscription customers will not receive any rebate or reimbursement of their Lifetime Subscription fees in the event of Early Termination unless they We are unable or unwilling to provide at least twelve (12) months of use of the Services. d) Looking Ahead allows you to upload digital copies of documents, photographs videos, and other digital materials (“Materials”). This functionality is provided for your convenience only and under no circumstances should you ever rely upon Looking Ahead as the sole depository of Your Materials. At all times you should keep originals or other digital copies, as the case may be, of Your Materials in another location, for safekeeping, as We will not be responsible for the loss, damage, or unavailability of Materials. User Responsible
e) Looking Ahead provides Services that can be useful and enjoyable in the management of your personal affairs. Nevertheless, the Services are not intended to be a substitute for obtaining appropriate legal advice from a qualified estates lawyer or other qualified professional, nor should the Services be relied upon by you as the sole mechanism for managing your personal affairs. The Services are only intended to complement your other arrangements for the sake of convenience. Accordingly, you must decide whether the Services are appropriate for you, given their limitations.
f) The Services involve your selection of at least two (2) “Authenticators”. The Authenticators which you select are intended to notify Looking Ahead of your death or incapacity. At least two such notifications from Authenticators are required before Looking Ahead will automatically notify your executor (in the case of death) or your power of attorney (in the case of incapacity). Accordingly, your selection of Authenticators is an important step. You should select Authenticators who you can trust and who are reliable, as only you will be responsible for their performance, not Looking Ahead. In addition, you should not rely upon your Authenticators only, and should have additional mechanisms in place outside if the Services, in order to arrange and manage your affairs in the event of death or incapacity.
Executors and Powers of Attorney.
g) Executors and persons who you give your power of attorney too, are of course intended to be trusted and relied upon by you as they fulfil an important function. If Looking Ahead receives two (2) Authenticator notices, your Executor or Power of Attorney, as specified by you, and as applicable, will receive read-only access to certain portions of Materials and other confidential data that you have supplied Looking Ahead, and as specified by you. Accordingly, you acknowledge and agree that Looking Ahead will notify the Executor and/or Power of Attorney at the contact details specified by you, upon Our receipt of at least two (2) Authenticator notifications. Only you will be responsible for the access which we provide in accordance with your instructions. Under no circumstances shall We be responsible for any unauthorized access and/or any resulting damage caused by the Authenticators and/or Executors and/or Powers of Attorney selected by You.
Keeping Your Data Current and Notices
h) Keeping contact details of your Authenticators and/or Executors and/or Powers of Attorney is your responsibility. We will use the most recent data that you provide to Us via the website. Failure to update contact details may result in inability to effectively notify Authenticators and/or Executors and/or Powers of Attorney, or may result in sending notifications to an out of date party. We are not responsible for ensuring that your desired recipients receive proper notice of any notifications that are provided as part of the Services, and accordingly you should take steps to arrange your affairs outside of the scope of the Services. Notifications will be sent by email only to the last recorded address on the website for designated persons. Furthermore, we are not responsible if your Authenticators and/or Executors and/or Powers of Attorney fail, refuse, or neglect to take any steps in response to receiving notification. You may want to advise each designated person of your wishes upon subscribing to the Services and inform them of your use of Looking Ahead.
Limitation of Liability
h): WE WILL NOT BE LIABLE FOR ANY (a) SUSPENSION OR LOSS OF THE SERVICES, (b) USE OF THE SERVICES, (c) INTERRUPTION OF SERVICES OR INTERRUPTION OF YOUR BUSINESS OR PERSONAL AFFAIRS, (d) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO OUR WEB SITE(S) OR SERVICES (e) LOSS OR LIABILITY RESULTING FROM ACTS OF OR EVENTS BEYOND OUR CONTROL (f) DATA NON-DELIVERY, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; or (g) LOSS OR LIABILITY RESULTING FROM THE UNAUTHORIZED USE OR MISUSE OF YOUR ACCOUNT IDENTIFIER OR PASSWORD OR UNAUTHORIZED ACCESS BY AN AUTHENTICATOR OF YOUR ACCOUNT. WE WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING BUT NOT LIMITED TO LOST PROFITS, LEGAL FEES, OR ESTATE RELATED LIABILITIES) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU FOR SERVICES, BUT IN NO EVENT GREATER THAN FOUR HUNDRED DOLLARS (CAD$400.00). BECAUSE SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH JURISDICTIONS, IF APPLICABLE,, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You, on behalf of yourself and on behalf of your heirs and successors, hereby release, indemnify, and hold Us, as well as Our contractors, agents, employees, officers, directors, shareholders, and affiliates of such parties harmless from and against any and all liabilities, claims, damages, costs and expenses, including reasonable legal fees and court costs, for third party claims, demands, requests, investigations, and proceedings, relating to or arising from your use of the Services.
A. In the event that any provision of these Terms And Agreement is deemed to be void or unenforceable in whole or in part it shall not affect or impair the validity of any other provisions noted in these Terms And Conditions.
B. It is agreed that the laws of the Province Of Ontario will apply to these Terms And Conditions and you , on behalf of yourself and your heirs and successors, hereby agree to attorn to the courts of the City of Toronto, for any disputes arising from or related to these Terms and/or your use of the Services.
C. All provisions contained within these Terms And Conditions shall constitute the entire agreement. No provision shall be removed without the prior written consent from Looking Ahead.
D. Should you not be able to access your account due to accidental or mistaken declaration of death (Code 1921), you will need to contact Looking Ahead at firstname.lastname@example.org.
Last Will and Testament is essential to an estate plan. Looking Ahead covers much more. For instance, a will does not start getting executed until well after one’s funeral. There are many immediate items that require attention - such as, funeral wishes - that unless documented, might not be carried out according to your wishes. Administering an estate is a large enough task - even when your affairs are organized. Gathering all of your critical documents (insurance, birth certificate, investment information etc.), instructions and wishes (should you not be able to speak for yourself) in one place will minimize financial burden and stress, and save time for your loved ones.
No. We encourage Looking Ahead subscribers to seek advice from professionals such as their financial advisors, accountants, and estate lawyers. Looking Ahead is a tool that helps store your critical documents, instructions and wishes according to what we believe is the best way to capture an effective estate plan; Incapacitation, Death, & Legacy. Our ultimate goal is to ensure your decision makers/Power(s) of Attorney/Executor(s) receive this information in one comprehensive package so they can expedite your wishes; and so your loved ones won’t have to make impulsive decisions at a stressful time.
Yes. An “Authenticator” plays a critical role in what we call, “Passing the Baton”. We recommend selecting at least 2 individuals who you trust implicitly to assume this role. Your Authenticator effectively gets your estate plan in the hands of your Power(s) of Attorney or Executor(s) by informing or confirming of a change in your status using the ‘alpha numeric code’ (password) we have provided.
Looking Ahead believes Authenticators should be aware of the user’s account and should ensure their email has “@lookingahead.com” as a safe sender.
You can delete, edit and add any of the above at anytime. Looking Ahead Inc. automatically deactivates alpha numeric codes for any deleted Authenticators.
(Please note that an “Authenticator” is a proprietary security feature created by Looking Ahead Inc. Changing “Executor(s)” or “Power(s) of Attorney” is a legal matter and must be completed by a Lawyer. These documents are notarized and changing them yourself will render them invalid.)
You can have your password resent to your email account by clicking, “Reset Password” on the Login page.
Looking Ahead built this functionality to prevent fraudulent use of a user’s account. If you cannot log into your account and receive a message, that means you are logged in on another device. If you believe someone is using your account without authorization, please change your password immediately in your Settings, or email us at, email@example.com
You can re-send their code anytime by clicking “send notification email” for the respective Authenticator in the ‘Authenticator’ section.
Estate plans require regular updating. Looking Ahead will provide notifications that remind subscribers to update or edit key information on a regular basis. There are certain documents (will or insurance) that are to be updated with your professionals and can be uploaded to your Looking Ahead account using your computer. Other items like your bequests, contacts, and legacy letters can be updated at any time using any iOS device or computer. The onus, however, is on the subscriber to keep their information current.
If your keyboard is designed to type in different languages, it will send your messages in the language you selected.
We plan to build an app for androids in the future.
Nobody will ever have access to your account until we have, “Passed the Baton” (see video), at which point, only your Power(s) of Attorney or Executor(s) will have read-only access to their respective sections. Authenticators do not have access to your account unless they are also either your Power(s) of Attorney or Executor(s). No one will ever have access to your Legacy section, at any stage - including your Power(s) of Attorney or Executor(s).
Buying the binder is optional. It has been designed to keep your original/notarized documents protected and arranged according to the layout provided in our online service - Incapacitation, Death, & Legacy. It includes 18 durable plastic inserts (custom built to hold up to 30, 8.5” x 11” pages); and when updates are made, you can easily print off individual pages or sections and add to your Looking Ahead binder.
We ship from Toronto, Ontario, Canada. You have multiple shipping options ranging from next day to standard UPS. The binder weighs almost 6 pounds and the dimensions of the box are 14x12x3 inches.
Yes. Go to your Settings. In the Credit Card section, click the, ‘Lifetime’ radio button. Your next billing cycle will automatically charge the difference.
A lifetime subscription includes all of the functionality currently available. Please review our Terms and Conditions. Looking Ahead may offer additional services in the future that are not included in the lifetime subscription.
You're Looking Ahead binder should be locked in a secure safe, filing cabinet, safety deposit box, or even in the hands of one's professional (e.g., estate lawyer). Protect your binder from damage and ensure only your decision makers have access to it.
You cannot add an image or attachment to “Legacy Letters” at this time. You can, however, upload photos and documents in the section “Death>Towards Completion>My Personal Assets and Bequests”. You can even access your camera and video recorder through our app using your iOS device. For instance, you can take a picture or video of a family heirloom or your classic car and easily indicate to whom you would like to leave them to. Please note that bequests are not items included in the will itself. A critical part of the Looking Ahead service is to provide a medium to ensure items such as letters and bequests (items not in a will) can be updated using your iOS device at any time under your control without the need for an estate lawyer.
As we grow, Looking Ahead plans to support more languages. In the meantime, if your Authenticator is computer savvy, you can walk them through the following 3 step process of, informing or confirming a change in your status:
i)how to access the website
ii)where to access and enter the alpha numeric code
iii)how to select, Incapacitation or Death option, Enter
If your Authenticator can follow these steps, they will be able notify your Power of Attorney(s) and/or Executor(s) how to access the relevant sections of your guide. Additionally, you can purchase a personal Looking Ahead binder to store hardcopies.
This is not currently an option.
